Terms of Service

1. Who you are agreeing with

These terms are between you and Ferrox Industries LLC (“we”, “us”), a limited liability company organised in Wyoming, United States and the operator of TripBuddy, at 30 N Gould St, Ste 50693, Sheridan, WY 82801, USA. By creating an account, joining the waitlist, or using the app, you accept them. If you do not accept them, do not use the service.

2. What TripBuddy is

TripBuddy is a travel planning assistant. It gathers what a group wants, drafts day-by-day itineraries with the help of AI, keeps the plan in one place, and points you at third parties where something can be booked.

TripBuddy is not a travel agency. We do not sell flights, accommodation, tours or tickets, we are not a party to any booking you make, and we hold no customer funds. When you book, your contract is with that provider, on their terms.

3. Early access

The service is in early access. It may be incomplete, it may change without notice, and features may be withdrawn. We may limit or suspend access, and we do not promise any particular level of availability during this period. Do not rely on TripBuddy as the only record of travel arrangements that matter to you.

4. Who may use it

You must be at least 13 years old, or older if the country you live in sets a higher minimum age for using a service like this without a parent’s consent. If you are under 18 you may use TripBuddy only with a parent or guardian’s involvement. If you use it on behalf of an organisation, you confirm you may bind it to these terms.

5. Your account

Keep your sign-in details to yourself, and tell us promptly if you think someone else has access. You are responsible for activity under your account, except where it results from our failure. You may use the app without an account; data held under an anonymous session may be lost if you clear your browser storage before signing up.

6. Acceptable use

You agree not to:

• break the law, or use TripBuddy to help anyone else do so;
• upload content that is unlawful, hateful, harassing, deceptive, or infringes someone else’s rights;
• try to gain access to accounts, data or systems that are not yours, or probe, scan or test our systems without written permission — see the Security page for how to report a vulnerability responsibly;
• scrape the service, resell it, or use it to build a competing product;
• overload the service, or automate access in a way that degrades it for others;
• use the AI features to generate content that is illegal or that you pass off as professional advice.

We may suspend or close accounts that break these rules.

7. Your content

Your trips, notes and messages stay yours. To run the service we need a limited licence to store your content, show it to the people you share a trip with, and process it — including sending relevant parts to our AI provider — so we can generate plans and answers for you. That licence is non-exclusive, worldwide, royalty-free, and lasts only as long as we need it to provide the service. It ends when you delete the content or your account, apart from copies that others in a shared trip already hold and backups that expire on their normal cycle.

You are responsible for having the right to upload what you upload, and for what you share with a group.

8. Copyright complaints

If you believe content on TripBuddy infringes your copyright, send a notice under the Digital Millennium Copyright Act to ali@tripbuddyai.com, with DMCA in the subject line, identifying the work, the material, your contact details, and the statements the statute requires. We will remove or disable material where appropriate and terminate repeat infringers.

9. AI output

Itineraries, suggestions and answers are generated automatically. They can be wrong, outdated, or entirely invented. Opening hours, prices, availability, travel times, visa and entry requirements, health rules and safety conditions must be checked against an authoritative source before you act on them. TripBuddy does not give legal, medical, immigration, financial or safety advice, and nothing it produces should be treated as such.

10. Third parties

Links to booking providers, maps and other services are provided for convenience. We do not control them, we do not endorse them, and we are not responsible for their content, their prices, their availability or their conduct. We earn no commission on them today; if that changes we will label them as paid.

11. Price

TripBuddy is currently free. If we introduce paid plans we will say so clearly before you are asked to pay, and nothing you have already paid for will change retrospectively.

12. Our intellectual property

The TripBuddy name, logo, mascot, illustrations, interface and code are ours or our licensors’. These terms give you permission to use the service, and nothing more.

13. Ending it

You may stop using TripBuddy and delete your account at any time from the profile screen. We may end or suspend your access if you materially break these terms, if we are required to by law, or if we discontinue the service — in which case we will give you reasonable notice and a chance to export what you have.

14. Disclaimers

The service is provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and any warranty that the service will be uninterrupted, secure, or error-free.

15. Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost bookings, missed travel, or loss of data. Our total liability arising out of or relating to the service is limited to the greater of the amount you paid us in the twelve months before the claim arose, or USD 100.

Some jurisdictions do not allow certain exclusions, so parts of the two sections above may not apply to you. If you are a consumer in the EEA or UK, nothing here limits liability that cannot lawfully be limited, including for death or personal injury caused by negligence or for fraud, and your mandatory statutory rights are unaffected.

16. Indemnity

You agree to indemnify us against claims arising from your content, your use of the service in breach of these terms, or your violation of law or of a third party’s rights.

17. Governing law and disputes

These terms are governed by the laws of the State of Wyoming, United States, without regard to conflict-of-law rules.

17.1 Talk to us first

Before starting arbitration or going to court, send a written notice of dispute to ali@tripbuddyai.comdescribing the problem, when it happened, and what you want. We will send you the same if the dispute is ours. Both sides then have 60 days to resolve it informally, and either side may ask for a call. Completing this step is a precondition to starting arbitration, and the limitation period is paused while it runs.

17.2 Binding individual arbitration

If the dispute is still unresolved after those 60 days, you and we agree that it will be resolved by binding individual arbitration rather than in court, before a single arbitrator, under the Federal Arbitration Act. The arbitrator decides all issues except those in section 17.6, applies the same law a court would, and may award the same individual relief a court could. The award is final and may be entered as a judgment.

Arbitration is administered by the American Arbitration Association under its Consumer Arbitration Rules. Under those rules the most you can be asked to pay in filing fees is USD 225; we pay the remaining administrative fees and the arbitrator’s compensation. Hearings are held remotely, or decided on documents alone, unless you ask otherwise.

17.3 No class actions

Claims are brought individually. You and we each waive any right to a jury trial and any right to bring or take part in a class, collective, consolidated or representative action. The arbitrator may not preside over any form of consolidated proceeding or award relief to anyone who is not a party. If this waiver is held unenforceable as to a particular claim, that claim — and only that claim — goes to court; the rest stays in arbitration.

17.4 Many similar claims filed together

If 25 or more similar claims are filed against us by or with the coordination of the same lawyers or firm, they will be arbitrated in batches of no more than 50 at a time, with a small number decided first as test cases and the remainder paused while the parties use those outcomes to try to settle, following the AAA’s Mass Arbitration Supplementary Rules where they apply. Nothing in this paragraph limits anyone’s individual right to be heard.

17.5 You can opt out

You may reject this arbitration agreement within 30 days of first accepting these terms. Email ali@tripbuddyai.com with the subject line Arbitration opt-out and the email address on your account. Nothing else changes if you do, we will not treat it as a reason to close your account, and the rest of these terms still apply. If you opt out, disputes go to the courts named in section 17.7.

17.6 What arbitration does not cover

• Either of us may bring an individual claim in small-claims court instead, so long as it stays there and stays individual.
• Either of us may ask a court for an injunction to stop infringement or misuse of intellectual property.
• Consumers in the European Economic Area, the United Kingdom and Switzerland are not bound by sections 17.2 to 17.5 at all. Pre-dispute arbitration agreements are generally not enforceable against consumers there, so we do not attempt it.

17.7 Where court proceedings happen

Where a dispute is not subject to arbitration, it belongs to the state and federal courts located in Wyoming, and both sides consent to their jurisdiction. If you are a consumer in the EEA, the UK or Switzerland, you may instead bring proceedings in the country where you live, and nothing here deprives you of the protection of mandatory local rules.

18. If you got the app from the App Store

These terms are between you and Ferrox Industries LLC alone. Apple is not a party to them and is not responsible for TripBuddy or its contents. What follows is what Apple requires us to tell you, and it applies only to the iOS app.

• Your licence to use the app is a non-transferable licence to run it on an Apple device you own or control, as permitted by the Usage Rules in the App Store Terms of Service.
• Apple has no obligation to provide support for the app. Support requests go to ali@tripbuddyai.com.
• If the app fails to conform to any warranty that applies, you may tell Apple and Apple will refund what you paid for it, which for TripBuddy is nothing. Beyond that refund, Apple has no other warranty obligation whatsoever, and any other claim, loss, liability, damage, cost or expense attributable to a failure to conform is ours to answer, not Apple's.
• We, not Apple, are responsible for addressing any claim you or anyone else makes about the app — including product liability claims, claims that it fails to meet a legal or regulatory requirement, and claims under consumer protection or similar law.
• If someone claims the app infringes their intellectual property, we, not Apple, are responsible for the investigation, defence, settlement and discharge of that claim.
• You confirm that you are not located in a country subject to a US government embargo or designated as terrorist-supporting, and that you are not on any US government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of this section, and on your acceptance of these terms Apple has the right to enforce it against you as a third-party beneficiary.

19. Changes

We may update these terms. If a change materially affects you we will give notice in the app or by email before it takes effect, and continuing to use the service after that means you accept the new version. If you do not, you may close your account.
